Chapter 7

A chapter 7 Bankruptcy allows for the discharge of certain types of debts in order to give the honest debtor a "fresh start". A major pre-requisite for eligibility in a chapter 7 is that the Debtor has no disposable income to pay creditors after paying all of their necessary living expenses, i.e. rent/mortgage, utilities, etc. Other pre-requisits apply which you should discuss with your attorney. A bankruptcy discharge will not extinguish a lien on your property unless certain circumstances apply which your attorney will discuss with you.
